Creator Agreement

Last updated: [Effective date]

This Creator Agreement is between you, a creator who publishes on BakuHub, and [Operator name] ("we", "us"). It applies together with the Terms of Service.

1. Your work stays yours

You keep the copyright and every other right in your work. We never take ownership of it.

If any right arises for us in the translated edition we make (the translated text and lettering), we assign it to you, and we use it only as section 2 allows. Our own technology, such as the Service's software and fonts, stays ours.

2. The licence you give us

While your work is published on BakuHub, you give us a non-exclusive licence to:

・store and copy it, and translate and letter it into the languages you choose;
・distribute, display and sell the original and its translations on the Service;
・use its cover, thumbnails and first pages to present and promote the Service.

The licence is non-exclusive: you are free to publish and sell the same work anywhere else, with any publisher or store.

3. What you may publish

Only work you created yourself, and for which you hold every right needed to publish, translate and sell it. If a co-author, publisher or anyone else holds rights in it, get their consent first.

You may not publish anyone else's work, fan works without the rights holder's permission, or work that an exclusive contract (with a publisher, say) keeps you from publishing here.

4. How we use AI

We use AI to translate and letter your pages. We never use your pages to train image-generation AI or to imitate your style. AI only translates the text and repairs the background where the text was removed; it never redraws your art.

The AI providers that process translations for us do so under [AI provider terms: your pages are not used for training].

5. Prices and earnings

You set your monthly subscription price ($3 to $20), each episode's price in credits, and each volume's price.

You earn what readers pay, less our fee (which includes payment processing). The fee is 20% on episodes whose translation you paid for (or that you published untranslated), and 40% on episodes whose translation we paid for.

If you pay the translation from sales, 50% of your share repays it until it is repaid, and then all of your share is yours. It is repaid from sales only: you never pay back from your own pocket what did not sell.

Sales that are refunded or charged back are deducted from your earnings.

6. Payouts

We pay you on the 1st of each month (UTC) for what you earned the month before.

・Method: [Payout method, e.g. Stripe Connect or bank transfer]
・Minimum: [Minimum payout] (smaller amounts carry over to the next month)
・Currency and fees: [Currency, exchange and transfer fees]
・Tax: you declare and pay the tax on your earnings. Where the law requires us to withhold tax, we withhold and pay it for you.

7. Takedown

If your work breaks the law, the Terms of Service or this Agreement, or a rights holder sends us a valid complaint, we may unpublish or remove it. Where we can, we tell you why.

If you find your work used by someone else without permission, write to [Email address].

8. Unpublishing and leaving

You can unpublish a series or an episode at any time from the Studio. The licence in section 2 then ends and nothing more is sold.

Readers who bought an episode or a volume before you unpublished it can keep reading it, unless it is removed for a rights problem.

If you close your account, we still pay what you earned up to then on the next payout day.

9. Changes

We will tell you at least 30 days ahead of any change that is worse for you, such as to the fees or payouts. If you do not agree, you can unpublish at any time.

10. Governing law

This Agreement is governed by the laws of Japan. The [Court] has exclusive jurisdiction in the first instance over any dispute about it.
